1. About us

1.1 Sanctum Fitness is run by Kennice McDougall, a sole trader trading as Sanctum Fitness, VO10, 5 Douglas Street, Dunfermline, KY12 7EB. Email: sanctumfitnessltd@gmail.com. In these terms, "we", "us" and "our" mean Sanctum Fitness, and "you" means the client.

1.2 These terms apply to all our services: face-to-face personal training at Limitless, Stirling; online coaching; group classes; and programmes such as The Winter Arc Project. By booking, paying for or starting a service, you agree to these terms.

2. Who can train with us

2.1 You must be 18 or over, or aged [16 or 17] with written consent from a parent or guardian who also agrees to these terms.

2.2 You must give us accurate information when you book and keep it up to date.

3. Health and safety

3.1 Before your first session or programme starts, you must complete our health questionnaire (PAR-Q). You must tell us straight away about any change to your health, including injuries, illness, medication or pregnancy.

3.2 If your answers show a possible risk, we may ask you to get clearance from your GP or another medical professional before training. We may delay or adapt training until we receive it.

3.3 You must stop exercising and tell us immediately if you feel pain, dizziness, chest discomfort, shortness of breath beyond normal effort, or feel unwell in any way.

3.4 We may change, pause or stop a session if we reasonably believe it is unsafe for you to continue.

3.5 For online coaching, you are responsible for training in a safe space, using equipment that is in good condition, and following the technique guidance we give you.

4. Bookings, prices and payment

4.1 Prices are shown on our website and social media and are in pounds sterling. We are not VAT registered, so no VAT is charged.

4.2 Pay-as-you-go sessions: £36 per 60-minute session, paid in full before the session (by Stripe payment link, or online when you book once online booking is live). Your session is confirmed once payment has been received and you have booked a time through our booking calendar (Calendly).

4.3 Session blocks: blocks of 4 sessions (£120) or 8 sessions (£210) are paid in full in advance. Sessions in a block must be used within [6 / 12] weeks of the first session, unless we agree an extension in writing (for example because of illness or injury). Unused sessions expire after that and are not refunded.

4.4 Online coaching: is £145 per month, paid monthly in advance [by Stripe subscription]. It continues each month until you cancel under section 6.

4.5 Programmes (e.g. The Winter Arc Project): are paid in full in advance. Programme dates, what is included and the price are set out on the programme page. Discounted prices (early bird, student, blue light) are only available on proof of eligibility, and early bird prices only within the stated dates. We may ask for proof and, if it is not provided, charge the difference.

4.6 We may change our prices at any time, but changes will not affect sessions or programmes you have already paid for. For online coaching, we will give you at least [30] days' notice of a price change.

4.7 Payments are processed by Stripe. We never see or store your full card details.

5. Cancelling or rearranging sessions

5.1 You can cancel or rearrange a face-to-face session free of charge if you give at least 24 hours' notice, using the link in your Calendly confirmation email or by messaging us. For a pay-as-you-go session you can choose a new time or a full refund. For a block session, the session goes back into your block.

5.2 If you cancel with less than 24 hours' notice or do not attend, the session is charged in full. Pay-as-you-go sessions are not refunded, and block sessions are not added back to your block. We may make an exception for genuine emergencies, at our discretion.

5.3 If you arrive late, we will wait up to [15] minutes. The session will still finish at the booked time so the next client is not delayed.

5.4 If we need to cancel or rearrange a session, we will give you as much notice as we can and offer a new time or a full refund for that session.

6. Cancellation rights and refunds

6.1 Your 14-day right to cancel: if you buy a service online or at a distance, UK consumer law usually gives you 14 days from the date of purchase to cancel and get a refund. If you ask us to start a service within those 14 days (for example, your first session or your onboarding happens in that time), you agree that we may deduct a fair amount for the part of the service already provided.

6.2 Some services booked for a specific date may not be covered by the 14-day right. [Solicitor to confirm which services this applies to.]

6.3 Online coaching: online coaching has a minimum term of 3 months from your start date.

6.3a After the minimum term, you can cancel at any time by giving one month's notice in writing (email is fine). Your coaching and payments continue until the end of the notice period.

6.3b Monthly payments are not refundable, including for part months or unused coaching, except under your 14-day right to cancel in 6.1.

6.3c If you cancel before the end of the 3-month minimum term, you must pay for the remaining months of the minimum term. We will take these payments on the usual dates or invoice you for the balance.

6.4 Programmes (e.g. The Winter Arc Project): after the 14-day period, or once the programme has started, payments are not refundable. If you cannot continue for medical reasons, tell us. We may, at our discretion, pause your place or move it to a future intake.

6.5 To cancel under this section, email sanctumfitnessltd@gmail.com or message us on Instagram. Refunds are made to the original payment method within 14 days of us agreeing the refund.

6.6 Nothing in these terms affects your legal rights as a consumer.

7. Online coaching

7.1 Online coaching is delivered through [coaching app name] and messaging. You need a compatible phone or device and an internet connection.

7.2 We aim to reply to messages within [1 working day], Monday to Friday. Weekly check-ins are reviewed within [2 working days] of being submitted.

7.3 Your results depend on you following the programme, submitting check-ins and telling us honestly how training is going.

8. Nutrition guidance

8.1 Any nutrition guidance we give is general healthy-eating and habit advice to support your training. It is not medical or dietetic advice. If you have a medical condition, food allergy or a history of disordered eating, speak to your GP or a registered dietitian before changing your diet.

9. Conduct and the gym

9.1 Face-to-face sessions take place at Limitless 24/7, Stirling. You must follow Limitless's rules, including any [membership, guest pass or induction] requirements. Limitless 24/7 (Unit 3, 35 Burghmuir Road, Stirling FK7 7PB) is a separate business and is responsible for its own premises and equipment.

9.1a Kennice McDougall is an independent, self-employed personal trainer. Sanctum Fitness is not owned by, part of, or acting on behalf of Limitless 24/7, and Kennice is not employed by Limitless. Your contract for personal training is with Sanctum Fitness only.

9.2 We expect clients to treat us, gym staff and other members with respect. We may end our services without refund if you behave in a way that is abusive, threatening or unsafe.

9.3 Community chats and group classes must stay respectful. We may remove anyone who breaks this rule.

10. Our content

10.1 Programmes, videos, guides and other materials we provide are for your personal use only. You must not share, sell or publish them without our written permission.

10.2 We will only use your photos, videos, results or testimonial in our marketing with your separate written consent. You can withdraw that consent at any time for future use.

11. Results and responsibility

11.1 We will provide our services with reasonable care and skill. Everyone's body responds differently, so we cannot guarantee any particular result, such as weight loss or strength gain.

11.2 Exercise carries some risk of injury. You take part voluntarily and agree to follow our instructions and the health and safety rules in section 3.

12. Our liability

12.1 Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot legally be limited.

12.2 We are not responsible for injury or loss caused by you not following our instructions, giving us inaccurate health information, training unsupervised against our guidance, or the condition of premises or equipment we do not control.

12.3 We are not responsible for loss or damage to your personal belongings at the gym.

12.4 Otherwise, our total liability to you is limited to the amount you paid for the service concerned.

12.5 Sanctum Fitness holds public liability and professional indemnity insurance with [insurer].

13. Complaints

13.1 If you are unhappy with any part of our service, please tell us at sanctumfitnessltd@gmail.com. We will reply within [5] working days and try to put things right.

14. Changes and law

14.1 We may update these terms from time to time. The version on our website when you book applies to that booking.

14.2 These terms are governed by Scots law. Disputes will be dealt with by the Scottish courts. If you live elsewhere in the UK, you may also bring proceedings in the courts where you live.
